Family Law Arbitration

Family Law Arbitration is another method of alternative dispute resolution (ADR) that can provide parties with a faster, more flexible resolution than traditional litigation. Rather than take months or years to litigate a matter, those who choose arbitration are able to quickly come to a resolution and move on with their lives.

More Than a Century of Combined Family Law Experience

If you are considering arbitration, the experienced family law attorneys at the law firm of Shimalla, Wechsler, Lepp & D’Onofrio, LLP, can help you. Our lawyers are committed to providing ADR methods, such as arbitration, as a way to resolve family law and divorce issues.

To learn more about ADR and family law arbitration, contact our Somerset County, New Jersey, office to schedule an initial consultation regarding your family’s legal dispute.

Arbitration can be binding or not binding, unlike mediation, and results in a decision made by a neutral arbitrator. The arbitrator plays a similar role as a judge, although there are meaningful differences between the judge’s role and the arbitrator’s role. At the outset, the parties decide whether the arbitrator’s decision will be binding and establish the specific ground rules to be followed in the arbitration. Through the process, the arbitrator hears testimony and accepts evidence. At the end of the arbitration hearing, the arbitrator will make a final decision about all of the issues presented in the case.

Benefits include the confidentiality of the process, and the fact that you are able to schedule hearing dates that work for you, rather than having to comply with the court’s schedule. Cases tried before judges take months, if not years, to resolve, while attorneys and clients are required to attend numerous court appearances, often without making progress in the cases. In arbitration, the parties, counsel, and arbitrator control the schedule and insure that time spent in the process is productive.

At our law firm, a number of our lawyers are qualified to serve as arbitrators. Furthermore, our lawyers frequently represent clients in family law arbitration. With our depth and breadth of experience, you can count on us to ensure that your best interests are carefully articulated.
