Arbitration can be binding or not binding, unlike mediation, and results in a decision made by a neutral arbitrator. The arbitrator plays a similar role as a judge, although there are meaningful differences between the judge’s role and the arbitrator’s role. At the outset, the parties decide whether the arbitrator’s decision will be binding and establish the specific ground rules to be followed in the arbitration. Through the process, the arbitrator hears testimony and accepts evidence. At the end of the arbitration hearing, the arbitrator will make a final decision about all of the issues presented in the case.
