Family Law Arbitration in Somerset County

Trust Our Experienced Arbitrators

Family law arbitration is a method of alternative dispute resolution (ADR) that can provide parties with a faster, more flexible resolution than traditional litigation. Rather than take months or years to litigate a matter, those who choose arbitration can quickly come to a resolution and move on with their lives.

If you are considering arbitration, our experienced family law attorneys at Shimalla, Wechsler, Lepp & D’Onofrio, LLP, can help you. We are committed to providing ADR methods, including arbitration, as a way to resolve family law and divorce issues.

What Is Arbitration?

Unlike mediation, arbitration can be binding or not binding. Arbitration results in a decision made by a neutral arbitrator. The arbitrator plays a similar role as a judge, although there are meaningful differences between the judge’s role and the arbitrator’s role. At the outset, the parties decide whether the arbitrator’s decision will be binding and establish the specific ground rules to be followed in the arbitration. Through the process, the arbitrator hears testimony and accepts evidence. At the end of the arbitration hearing, the arbitrator will make a final decision about all of the issues presented in the case.

Benefits of arbitration include the confidentiality of the process and the fact that you are able to schedule hearing dates that work for you, rather than having to comply with the court’s schedule. Cases tried before judges take months, if not years, to resolve, while attorneys and clients are required to attend numerous court appearances, often without making progress in the cases. In arbitration, the parties, counsel, and arbitrator control the schedule and ensure that time spent in the process is productive.
