Under New Jersey law, you are entitled to equitable division if your spouse’s retirement account was established and/or grew from contributions made during the course of your marriage. We understand these requirements and can help with the allocation and division of pensions and retirement plans through Qualified Domestic Relations Orders (QDROs) and Domestic Relations Orders (DROs). Even though your marriage has ended, you can still protect your rights to retirement account benefits that will be paid in the future.
Qualified Domestic Relations Orders (QDROs)
Qualified Domestic Relations Orders are court orders that govern the division of certain retirement benefits following a divorce. These can be pensions, 401Ks, or other retirement plans. The QDRO instructs the retirement plan administrator on how benefits will be divided between the two spouses.
Domestic Relations Orders (DROs)
We also assist clients with Domestic Relations Orders (DROs) for nonqualified plans. These include retirement benefit plans for teachers, firefighters, police officers, and government employees.
