Domestic Violence Attorneys in Somerset County
Protecting You & Your Rights in Domestic Violence Matters
An emotional situation between spouses or partners can escalate quickly. Unfortunately, these emotions can lead to threats, harassment, or even assault between family members, roommates, and dating couples. When that conduct warrants protection under the law, our Somerset County domestic violence attorneys can provide representation.
Domestic violence is taken very seriously in New Jersey, as it should be, and the consequences can be swift and severe when protection is needed. While victims of domestic violence need those protections, there are also instances in which individuals file false domestic violence charges to gain an advantage during divorce or custody disputes. At Shimalla, Wechsler, Lepp & D’Onofrio, LLP, we protect our clients and their rights when domestic violence issues arise. We are dedicated to ensuring the safety and protection of victims as well as asserting the rights of those falsely accused of domestic abuse.
A TRO (Temporary Restraining Order) is available for anyone age 18 and over who has been threatened or victimized by domestic abuse. If you are in danger, contact your local police department. A TRO can also be obtained through the county courthouse during normal business hours.
Once a TRO is filed, a hearing is usually scheduled within 10 days to determine whether an FRO (Final Restraining Order) should be entered. The entry of an FRO against an individual can have a significant impact on a person’s ability to re-enter their home, see their children, and gain future employment. This issue is especially sensitive as FROs do not expire in New Jersey. They remain in effect until they are voluntarily dismissed or dissolved by court order.
Our Somerset County domestic violence lawyers work to resolve issues and represent clients in family court hearings regarding Temporary Restraining Orders, Consent Orders, and Final Restraining Orders. We can represent you in obtaining a Final Restraining Order, or, if you are disputing a TRO that you feel has been unfairly entered against you, we can represent you in defending yourself as well.
Protecting Victims of Abuse
Our attorneys are committed to asserting the rights of abuse victims. If you or a loved one is in danger, we can help you take legal action to prevent future harm or abuse. Whether the abuse involves a divorce proceeding or you have been victimized throughout your relationship, we can help you protect yourself and your children from an abuser.
In certain situations where one spouse severely injures the other, a claim for compensation for injuries may be made. This is referred to as a Tevis claim. There are other limited circumstances in which this could apply as well.
Domestic Violence Defense
Our family attorneys are experienced in handling domestic violence cases that involve false accusations and can help you defend yourself against the finalization of a TRO. Without skilled defense, you may risk losing custody, your professional license, any weapons you may own, and access to your home. You may even subject yourself to possible jail time in the event of a violation of a restraining order. If you are the subject of a TRO, it is important to discuss your situation with a domestic violence lawyer as quickly as possible. Shimalla, Wechsler, Lepp & D’Onofrio, LLP is here for you.
