Change or Terminate a Spousal Support Order
Changing spousal support or alimony arrangements in the years following a divorce can be a contentious topic. There are times, however, when modifying spousal support is warranted. Anyone who wants to change alimony must seek permission from the court or reach an agreement and formalize an order with their ex-spouse. As with any important family matter, you should retain skilled legal counsel to ensure that your request is handled professionally.

Successfully Modifying & Terminating Alimony Orders
On September 10, 2014, New Jersey laws relating to spousal support changed in many ways, and, in 2018, federal tax law significantly changed the rules about the tax treatment of alimony. While many of these changes to the law only apply to divorce cases going forward, in some cases it will be easier for some people to modify or terminate their alimony. In seeking modification of alimony, it is important to understand how the new tax rules will affect the result.
For instance, if you have reached the full Social Security retirement age and you are actually retiring, you may be able to terminate your alimony obligations.
A non-temporary and substantial change in circumstances is required for post-decree modifications.
Spousal support modification in Somerset County is possible if one person’s financial situation changes significantly due to circumstances such as:
- One spouse’s income increases or decreases
- One spouse retires, loses a job, or suffers another substantial financial loss
- One spouse’s health changes
- The receiving spouse moves in with a partner
If the person receiving support remarries, support will terminate. It may also be terminated in situations involving the payer’s long-term unemployment, disability, or retirement at full Social Security retirement age.
Whatever your situation may be, our Somerset County alimony modification lawyers can give you the information you need to make educated decisions about your future.
